this query throws an index out of range exception because of the Union but i don't know why :/

I did not see any errors in this code. Can you show us the stack trace? What is the type / value of the variable query? –  mortb Jan 7 '13 at 10:51
I added the query code. The error come from the Union –  Xxbz Jan 7 '13 at 11:01

I have a compile error if i remove .ToList() because the property Files is a List<T> –  Xxbz Jan 7 '13 at 11:17
I'm not sure, but seems like .ToList() cannot be evalueted into LingToSql query. Try to select anonymous object instead of MyCleanerFolder just to check it. –  2kay Jan 7 '13 at 11:23
