if I create a controlgroup statically, its legend is perfectly vertically arranged. But when another controlgroup is created dynamically, its legend is aligned at the top.

$('#datum_2_fields .ui-controlgroup-controls').find('div').first().remove();
$('#zeit_1_fields .ui-controlgroup-controls').find('div').first().remove();
$('#zeit_2_fields .ui-controlgroup-controls').find('div').first().remove();

great !! If you have more than two datum_fields or zeit_feilds try to use any loop to remove the unwanted div instead of writing code for every feild. –  Venu Gopal Mar 25 '13 at 8:44
Cool, in jsFiddle it now works as expected. Unfirtunately, not in my project. I need to find out what's the difference. But anayway, thanks for pointing me into the right direction! –  AntonSack Mar 25 '13 at 9:46

unecessarily one more extra div

<div class="ui-controlgroup-controls"></div>

was added. Try the div not to added.

even second fieldset have <div class="ui-controlgroup-controls"></div>. did u try removing that? –  Venu Gopal Mar 23 '13 at 14:36
Hi Venu, this setting is coming from the jquery.mobile.xxx.css. What would be the right way to remove it? ...removeClass(), I assume but when? After the dynamic creation of the controls? –  AntonSack Mar 23 '13 at 18:41
I tried $('#datum_1_fields').children().removeClass('ui-controlgroup-controls'); after creation of the controls but this did not help. –  AntonSack Mar 23 '13 at 18:55
