My company has built a small, extremely niche search engine. Globally, we are only indexing about 15,000 websites.
A question has come up in house - how to deal with the images that we find as part of our indexing?
Every item of a search result has a link, thumbnail (if available), and description of about 300 characters. When clicked the title link sends the user to the website from which the data was retrieved. Not unlike Google, btw.
When dealing with the thumbnail and related images on the site, we have the option of hotlinking to the images on their site, or we have the option to download the resources and keep it on our server.
Of course we would prefer to hotlink it as it would save us costs in storage and bandwidth resources. Is it illegal to hotlink to resources from other sites?
But if we download it, are we actually allowed to download it? It's an American company, so would this fall under fair use copyright laws?
How do Google, Yahoo, and other search engines approach this issue?
