I was about to ask a question, however I found the same Question which was asked before and it is still unanswered, please take a look at :

jQuery UI Dialog - modal window temporarily covers dialog during effect

any idea to prevent this? I mean, running the effects above the gray layer, not under it!

I acctually don't now why this happens, but I never had such an experience.

How much javascript do you use in your application? Maybe it's an efficiency issue and you application is slowed down because of too much DOM manipulation.

To ensure that dialog comes up first you could overwrite the dialog method or write your own based on jQuery Dialog. So you should apply the background layer after you open the dialog.

Also check you're using the current jQuery version, maybe it's a bug.

I'm using the latest jQuery releases jQuery 1.5.2 and jQuery UI 1.8.11 .... you didn't use effect for your example,you can see an updated version of it here : jsfiddle.net/5vxnU/6 same problem exists... –  Javid_p84 Apr 13 '11 at 10:55
Be sure you supply a valid css file. But it seems this is a bug because you code is right. You can post it on the bug tracker for jquery ui –  artworkad シ Apr 13 '11 at 17:05
