So I need to set the modal to false when the dialog is open already and have the overlay behind the dialog hide. This is what I have tried,

when I open the dialog I have a set of functions that query a drag drop event on a calendar if it is a multiple event then I need to make the dialog NOT modal and allow further interactivity with th calendar to move another event.. then validate.

$(this).dialog("option", "modal", false);

When I use this It doesn't make the dialog's overlay hide. Am I getting something obvious wrong???

I have come up with a work around, but the dialog should still hide the overlay when I set the option... Heres the workaround.. $('.ui-widget-overlay').hide(); –  Dave Robertson Apr 19 '11 at 3:17

I inherited a project that uses jQuery UI from Developer X. Instead of using jQuery UI, Developer X uses her own code to make dialog boxes appear to be "modal". She uses a "mask" element that she toggles using jQuery.fadeIn and jQuery.fadeOut. You could do something similar to get the effect you want. You may try using some CSS like this to get started:

      left: 0px; /* start from left */
      height: 100%; /* cover the whole page */
      width: 100%;  /* cover the whole page */
      display: none; /* don't show it '*/
