@MarkRotteveel We are using 3.0. I have read that connect issue, but I'm kind of hopeful someone else has run into the WHERE clause behaving unexpectedly.

Thanks @LuiggiMendoza Yhea, forgot to mention it, we have discussed migrating to JTDS but it's not something we can change lightly, and testing it would probably take us the same amount of time as changing to DATETIME2 data type.

I tried it, it doesn't work, it's returning the same data but it's 'filtering' those rows where the StartDate and EndDate are the same.

i just finish making few tests with a smaller sample (2M records), and both solutions (yours and david's) and both take the exact time to run. Tomorrow I'll test what happens with 12M but im not expecting much of a difference. thank you

I have tried my solutions with a smaller sample. @hova: yes they are. I'm going to try doing it this way, but i can't think of a solution that will give me my desire performance (at least right now)

depending on how updated you need your data to be, you could build the cubes straight from the sql2000 instance. Where i work they have a similar problem and every night the cubes are build taking the data from the other instance, a star schema is obtained trough views, it was done this way just to avoid the etl process...

Thats not correct. WITH GRANT helps doing stuff like that in sql server. Thats why I'm asking, i'm hoping there would be a way of achieving what i want.
