using the first form, with a closing tag, my form works just fine. Using the second form, without a separate closing tag, the "tabs" javascript raises errors.

Would I be right in saying that if any of the validators report an error, the server-side button click never fires ? It seems to be the case - but that's not a great user interface (you click a button and nothing happens), hence my intention to say "sorry, you can't do that" when there are errors, and "do you want to do that" when there aren't. I haven't even dare look into the scenario of "there's no errors and the user clicks the button twice".

There is a second subtlety as well. When you select "for Xml", you get a row when some Xml is generated (ie. some source records match your criteria), or you get zero rows. When you (effectively) make the Xml generation a sub-query, you always get a row. You then have to determine the absence of data by means other than the row count.
