it's not really clear what you use is_active_sidebar for? Do you want to test if the widget is currently in 'sidebar-1' ? if this is what you are looking for then there is no function to test that, you must use CSS or JS to change the look of your widget depending on what sidebar it's in.

I guess the performance of count will depend on the indexes, anyway, if what you really want to do is change the home page and only the home page you should write a template in your theme that do exactly what you want. Since the pagination is part of your theme just don't put pagination in that template and you won't have any count done. Once you have your template create a page using that template then set that page as your home page.

about the 404 I am not sure, you are returning a list of objects then just return an empty list, not a 404, I would return a 404 if the API was expected to return a single object. But then again, it should be the job of the framework to deal with what Http response must be sent back, you deal at the model level, you should only send objects or business exceptions
